Please read these Terms & Conditions (“Terms”) carefully before using evoketypestudio.com (the “Site). For the purposes of this policy, “We”, “Us” and “Our” refers to Evoke Type Studio while “You” and “Your” refers to any user accessing any part of this Site.

Access and Use

Your access to and use of the products within Evoke Type Studio is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use evoketypestudio.com and its products. By accessing or using evoketypestudio.com, you agree to be bound by these Terms. If you disagree with any part of the Terms, then your access to products related to Evoke Type Studio may be limited and/or terminated.

Content

All Intellectual Property on the Site remains the property of Evoke Type Studio. Products are made available for sale at the sole discretion of Evoke Type Studio and may be withdrawn at any time.

Purchases

Evoke Type Studio offers you online individual sales via the Site only. For business licensing, please contact us for a quote.

All right and title to Intellectual Property on the Site remain the property of Evoke Type Studio.

Payment Process

You agree to pay Evoke Type Studio the fees stipulated on the Site as the price for the Product ordered.

Online prices are advertised and quoted on the Site in USD (United States Dollar). Currency conversion into your currency is handled by the payment service provider chosen, PayPal or Stripe.

Prices advertised are exclusive of Sales Tax or VAT unless otherwise stated at checkout. Should Sales Tax or VAT be charged, you will be charged based on the location your IP address is hosted in at the time of purchase and the Sales Tax/VAT rate as published by said location at the time of purchase. On check out, a quote will be produced illustrating the breakdown of the purchase before being redirected to make a payment.

The PayPal and Stripe payment models are redirect models and they handle the entire payment process. Evoke Type Studio does not store any payment card or account information. As PayPal and Stripe are third party service providers, your personal information, such as your name, email address and billing address, may be passed to PayPal in accordance with our Privacy Policy to facilitate the payment.

The Product will be provided to you once payment has been successfully made to Evoke Type Studio.

Custom Art

Custom Art Purchases include: 1 custom artwork with 2 rounds of revisions and standard shipping. Additional copies of prints may be purchased at an additional cost. Additional changes beyond the 2 rounds of revisions will be assessed by the estimated time to complete the requested changes at an hourly rate of $60 per hour. Should additional funds be required (either for additional rounds of changes or additional copies of prints), a private listing will be made for you. This additional listing will need to be purchased before either the additional work can be completed (for more changes) or the artwork is sent to the printer (for more copies).

Evoke Type Studio reserves the right to refuse or cancel a custom order at any time. If your order is cancelled by Evoke Type Studio, you will receive a full refund. Custom art requests that insinuate hate speech of any kind will be refused and the order cancelled and refunded. If you would like to cancel your order, please contact Evoke Type Studio about cancellation prior to returning your selections sheet and a full refund will be issued. If you wish to cancel after submitting your selections sheet and work has already begun for your artwork, a refund will not be issued. Custom art prints are created for personal use only. If you are interested in custom art for commercial use, please contact hello@evoketypestudio.com.

By purchasing, you agree to not copy, alter, or distribute the custom art in any form. Any reproduction or redistribution of the artwork, duplication and /or editing of artwork is expressly prohibited under copyright laws.

Special Offers/Promotions

From time to time, Evoke Type Studio may introduce special offers or promotions. These may be subject to separate terms which we will publish on our Site at the time.

Processing & Shipping

Please allow for the following processing and shipping times for your order. Business days are Monday - Friday, excluding holidays. Please note processing times are separate from shipping times.

Processing:

Art Prints & Posters: 1-4 business days

Notecards & Postcards: 1-3 business days

Shipping:

2-7 business days

All physical products that are in stock are shipped from Boston, Massachusetts. Any art prints and posters not currently in stock are printed and shipped directly from our print partner in Texas.

Refunds & Cancellations

Unused and unopened products may be returned within 30 days of receipt for a full refund less the original shipping cost. Custom art products are subject to cancellations according to the custom art terms. Customers are responsible for any return shipping costs. Used, opened, and/or final sale items cannot be returned.

If you wish to return an item that you purchased or was gifted to you, please contact orders@evoketypestudio.com to initiate the return process.

Once you have contacted us regarding the return, please send your order and its original unopened packaging to:

Once we receive the returned item(s), we will credit your original method of payment excluding non-refundable shipping costs as soon as possible. Regardless of the date an order is placed, if the original form of payment has expired at the time a refund for a return is processed, a store credit will be issued and a refund will not be provided.

Please note refunds may take 2-3 weeks to process and show on your account due to varying processing times between payment providers.

If a return exception is made for an order past 30 days, a store credit will be issued and a refund will not be provided.

Privacy

All your information is stored securely by Evoke Type Studio and is used to provide you with the products ordered, in the collection of fees for products and communication between Evoke Type Studio and you. While Evoke Type Studio employs safety measures when interfacing with its customers, suppliers and other partners, you should be aware that there is an inherent risk in transmitting any data electronically. This risk is inherent in all internet dealings and you agree to defend, indemnify and hold harmless Evoke Type Studio from any loss resulting from any external parties obtaining your stored information due to systems failure or otherwise.

We are in possession of information that identifies you and you agree that we can use your Personal Information to verify your identity, accuracy and completeness of the information you provide to us; open, administer and service this agreement; statistical analysis; to develop and improve our services; update your records; to identify which of our or other services might interest you.

Your Personal Information is held subject to the Privacy Policy of Evoke Type Studio which you hereby confirm that you have read, understood and agree to.

Copyright and Intellectual Property Rights

Copyright and all Intellectual Property Rights in all products, font software and data made available on the Site are owned by Evoke Type Studio and are protected by intellectual property laws. Accordingly, any unauthorized copying, reproduction, retransmission, distribution, dissemination, sale, publication, broadcast or other circulation or exploitation of such material or any component thereof will constitute an infringement of such copyright and other intellectual property rights; save that you may use the materials or any component thereof for the purposes of ordering products from the Site.

Digital Products for sale on the Site are sold subject to their own agreement as defined by their End User License Agreement (EULA), which is an extension of the Terms and Conditions as defined in this agreement.

Rights of Evoke Type Studio

Evoke Type Studio reserves the right to refuse services to anyone. Evoke Type Studio may, in its sole discretion, immediately terminate this Agreement if the subscriber is in breach of the Terms.

This Agreement, Evoke Type Studio policies, website, web service, database, pricing, and documentation are subject to change by Evoke Type Studio without notice. Continued usage of the services after a change to the Agreement by Evoke Type Studio or after a new policy is implemented and posted on the Site constitutes your acceptance of such change or policy. We encourage you to regularly check the Site for any changes. This document is made publicly available via https://evoketypestudio.com/terms-conditions.

Evoke Type Studio may link to third-party web sites or services that are not owned or controlled by Evoke Type Studio. Evoke Type Studio has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party website or services. You further acknowledge and agree that Evoke Type Studio shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

Your Undertakings

By using this Site, you agree to accept all the terms and conditions of this agreement; agree to be bound by the declarations and Terms contained in this Agreement, as well as those contained in the Checkout process and all subsequent EULAs for digital products purchased on the Site; acknowledge that we are relying on the information that you have given us; unconditionally absolve and indemnify us from and against any loss, damage, costs or expenses which either we or you may sustain or incur, either directly or indirectly as a result of our relying on and using the banking details and/or any information supplied to it by you or on your behalf, in order to pay the proceeds or collect amounts owing in respect of the Agreement; agree that we will not be liable in respect of any errors or omissions from any particulars given to us by you or on your behalf; agree and consent to your personal information being dealt with in terms of the provisions of this Agreement and to our Privacy Policy which you have read and agreed to.
